Website Terms of Use
Last updated: 4 November 2026
1. Identification
This website (artsmater.com) is operated by M - Fine Art Auctions Unipessoal Lda, legal entity no. 518 686 663, with its registered office at Avenida Infante D. Henrique, 26, 1149-096 Lisbon, which runs the MATER Fine Art auction house (hereinafter, “MATER Fine Art”).
Contact: info@artsmater.com · Rua Dom João de Castro 76 A/B, 1300-194 Lisbon.
2. Purpose of the website
The website presents MATER Fine Art and its activities: auctions and their lots, results, the Materbook (the auction catalogue), the Journal, the services provided (including valuation and consignment) and the auction house's contact details. It also allows users to subscribe to the newsletter, send contact and quote requests and access the customer area.
3. Acceptance of these terms
By using the website, the user accepts these Terms of Use. If the user does not agree with them, they should not use the website.
4. Conditions of sale and auction rules
These terms govern only use of the website. They do not contain MATER Fine Art's conditions of sale or auction rules, which are separate documents published with each auction and available from the auction house. Participation in an auction, the submission of purchase orders or telephone bids and any purchase or consignment are governed by those documents, which take precedence over the information displayed on the website.
5. Information about lots
Descriptions, photographs, dimensions, estimates and other information about lots displayed on the website are provided for information only and are not binding. The colours and details in photographs may vary depending on the screen and lighting. Information may be corrected or supplemented up to the time of sale, and a lot may be withdrawn from the auction.
In the event of a discrepancy, the auction catalogue and conditions of sale take precedence. MATER Fine Art recommends examining lots in person during the viewing, and its team is available to provide further information, including condition reports.
6. Intellectual property
The texts, photographs of artworks and lots, catalogues, Materbook, Journal, website graphic design, logo and MATER Fine Art brand belong to MATER Fine Art or their respective rights holders and are protected by copyright and industrial property legislation.
Artworks reproduced on the website may be protected by the copyright of their creators or heirs. Their reproduction on the website is for the purpose of promoting the sale and does not grant the user any rights over them.
Without MATER Fine Art's prior written permission, users may not copy, reproduce, distribute, modify, publish or use any website content for commercial purposes. Users may share links to website pages and view and print content for personal, non-commercial use.
7. Permitted use
The user agrees to use the website in good faith and in accordance with the law. In particular, users may not:
- extract content or data from the website systematically or automatically (for example, by scraping), except for search engines for indexing purposes;
- attempt to access areas or systems that are not open to the public, or interfere with the website's operation and security;
- send unlawful, offensive or advertising content, or third-party data without permission, through the forms;
- impersonate another person.
8. Customer area
Registration in the customer area is personal. The user must provide accurate, up-to-date information and is responsible for keeping their password confidential. MATER Fine Art validates each person's first registration for an auction and may refuse or suspend an account used in breach of these terms or the law.
For a lot in an open auction, the customer area allows the user to leave a purchase order (the maximum amount up to which MATER Fine Art bids on the user's behalf) or request a telephone bid, stating the telephone number and the language in which they prefer to be contacted during the auction.
Purchase orders and telephone bids submitted through the customer area are governed by the conditions of sale for the relevant auction (see section 4).
9. Newsletter
Newsletter subscription is free of charge and requires confirmation of the email address (double opt-in). It can be cancelled at any time through the link in each newsletter. Data processing is described in the Privacy and Cookie Policy.
10. Contact and quote requests
Requests sent through the website's forms do not constitute a contract. A quote or valuation estimate given in response to a request is indicative and binds MATER Fine Art only under the terms of a written contract.
11. Links to third-party websites
The website contains third-party links and content, including:
- ISSUU, where the Materbook is displayed, as described in the Privacy and Cookie Policy;
- Google Maps, Waze and Apple Maps, for directions — these are links only;
- MATER Fine Art's social networks.
These websites and services are the responsibility of their respective operators, which have their own terms and privacy policies. MATER Fine Art does not control and is not responsible for their content or availability. The data processing associated with these services is described in the Privacy and Cookie Policy.
The map image displayed on the website is generated from OpenStreetMap data (© OpenStreetMap contributors).
12. Limitation of liability
MATER Fine Art seeks to keep the website available and the information accurate and up to date, but does not guarantee that the website will operate without interruption or errors, or that the information will always be complete or free from inaccuracies. To the extent permitted by law, it is not liable for damage resulting from use of the website or inability to use it, or for decisions made solely on the basis of information displayed on it, in particular information about lots (see section 5).
Nothing in these terms excludes or limits MATER Fine Art's liability where the law does not allow it, including in cases of wilful misconduct or gross negligence, or any rights granted to consumers by law.
13. Privacy
The processing of personal data through the website is described in the Privacy and Cookie Policy.
14. Changes
MATER Fine Art may amend these Terms of Use at any time. The version in force is the one published on the website, with the date of the last update shown at the top.
15. Applicable law
These terms are governed by Portuguese law. If the user is a consumer, the legal rules on court jurisdiction and the mandatory rules protecting consumers apply.
16. Alternative dispute resolution and complaints book
More information about alternative resolution of consumer disputes is available on the Consumer Portal.
Consumers may also lodge a complaint through the Electronic Complaints Book.
